Even the final judgment announced by the judge handling the case was shocking to say at least. The final judgment was made against Dr. Mahtani’s claims. As a result, Dr. Mahtani has now approached the higher court of appeal and made an appeal against this judgment.

Dr. Rajan Mahtani Takes Unprecedented Step, Moves To Higher Court After Court Verdict

During his more than three decades of stay in Zambia, Dr. Rajan Mahtani has seen numerous ups and downs. He is among the most successful and celebrated businessmen in Zambia. His successful businesses can be found not only in Zambia but also across many foreign nations. Some of his established businesses include Finsbury Investments, Mahtani Group of Companies and Finance Bank Zambia. Yet, he is also among the most conspired upon businessmen in Zambia with numerous individuals, groups and even companies constantly trying to ruin his reputation or business. On the other hand, Dr. Rajan Mahtani has never been found to have engaged in similar conspiracy based activities or ruining someone else’s image or business for personal reputation. Instead, he has devoted majority of his time into development of his companies and the communities, philanthropic activities as well as working for the underprivileged sections of the society.

For the past ten years, Dr. Rajan Mahtani has been fighting a case at the Lusaka High Court. This case is for the legal takeover of the Portland Cement Zambia factory, a noted cement-manufacturing factory which originally belongs to Dr. Rajan Mahtani. The reason behind long pendency of the case is majorly the limitations and shortcomings of the Zambian law and government. Some good news was announced a few months ago when the judge handling the Portland Cement Zambia case concluded the case hearing and requested both parties to submit evidences, based on which final judgment was to be announced.

However, the final judgment was shockingly made against Dr. Mahtani’s claims even though most of the documents submitted suggested otherwise. Dr. Mahtani has now filed an appeal to the higher court of Zambia.

Dr. Rajan Lekhraj Mahtani Appeals To Higher Court Of Justice For Portland Cement

Dr. Rajan Mahtani is a noted businessman in Zambia and is among few industrialists who are still known for his transparent and ethical business functions. He is also a noted philanthropist and regularly contributes to the society and the underprivileged sections of the society with his charity works. For the past ten years, Dr. Mahtani has been fighting for the legal takeover of the Portland Cement Zambia factory.

During this time, Dr. Mahtani shared several evidences before the court to prove his claim over the factory. Some of these evidences included signed shareholder’s agreement, financial exhibits and audit reports from independent auditor which clearly indicated that the Portland CementZambia factory was established as a joint venture entity and Dr. Rajan Mahtani is the real and legal joint venture partner. At the same time, the financial exhibits clearly showcased that Dr. Mahtani had investment more than USD 12 million worth of money into the growth and development of the factory. These evidences were clear enough to prove that Dr. Rajan Mahtani is the legal owner of the factory.

However, the final judgment announced by the court was unexpected and unprecedented. It was given against Dr. Mahtani’s claims, even after submitting all those evidences which sufficiently proved Dr. Mahtani ownership over the factory. Not with standing this skewed judgment, Dr. Mahtani has now appealed to the higher court of Zambia. In his new appeal, Dr. Mahtani has shared all those evidences and has requested the higher court to look into this matter. Reply is awaited from the higher court as of now but Dr. Mahtani is hopeful of their judgment.

Dr. Rajan Mahtani Not Afraid To Challenge Court Decision, Appeals To Higher Court

It is true that the path towards righteousness is never easy. While people can easily win by illegal and unethical methods, these are just short-term strategies for achieving something. Dr. Rajan Lekhraj Mahtani is among the few businessmen left in Zambia who still follow this difficult path of truthfulness and honesty in all of his operations, irrespective of whether he receives support from government or his industry counterparts or not. As a result, Dr. Rajan Mahtani is stuck with the case of Portland Cement Zambia which has become one of the longest running corporate cases in Zambia.

The latest judge handling this case was Justice Nkonde and he gave positive news a few months back when announcing that the case hearing for the Portland Cement Zambia is closed and both sides were requested to submit their updated evidence, documents as well as testimonials in written and oral format before the judge. Based on this evidence, the judge was supposed to provide a final verdict. It was positive news for Dr. Rajan Mahtani as his evidence were much stronger and sufficient enough to prove his claim. The high court judge even commended the achievement of this long-pending case.

However, everything changed when the final verdict was announced. The judge announced the final verdict against Dr. Mahtani claim which was a shocking event. However, Dr. Mahtani and his lawyers have considered this judgment by the Lusaka High Court judge to be skewed and misdirected and has appealed to the higher court of Zambia against this judgment with reply awaited.
