Dr. Rajan Mahtani
is a noted businessman in Zambia and is among few industrialists who
are still known for his transparent and ethical business functions.
He is also a noted philanthropist and regularly contributes to the
society and the underprivileged sections of the society with his
charity works. For the past ten years, Dr. Mahtani has been fighting
for the legal takeover of the Portland Cement Zambia factory.
During this time,
Dr. Mahtani shared several evidences before the court to prove his
claim over the factory. Some of these evidences included signed
shareholder’s agreement, financial exhibits and audit reports from
independent auditor which clearly indicated that the Portland CementZambia factory was established as a joint venture entity and Dr.
Rajan Mahtani is the real and legal joint venture partner. At the
same time, the financial exhibits clearly showcased that Dr. Mahtani
had investment more than USD 12 million worth of money into the
growth and development of the factory. These evidences were clear
enough to prove that Dr. Rajan Mahtani is the legal owner of the
factory.
However, the
final judgment announced by the court was unexpected and
unprecedented. It was given against Dr. Mahtani’s claims, even
after submitting all those evidences which sufficiently proved Dr.
Mahtani ownership over the factory. Not with standing this skewed
judgment, Dr. Mahtani has now appealed to the higher court of Zambia.
In his new appeal, Dr. Mahtani has shared all those evidences and has
requested the higher court to look into this matter. Reply is awaited
from the higher court as of now but Dr. Mahtani is hopeful of their
judgment.
