The case between Dr. Rajan Mahtani and the Ventriglias is known to everyone. It is for the ownership of the Zambezi Portland Cement, a premier cement factory at Zambia. The cement factory was taken by force by the Ventriglias almost nine years ago. Since then, Finsbury Investments Limited owner Dr. Rajan Mahtani has been fighting the case at the Lusaka High Court.
The case took a positive turn when the judge handling this case announced that the hearing of the case is concluded and the final judgment will be announced soon. Since the case was launched, Finsbury Investments have shared various evidence and facts that justify their ownership over the cement factory. First of all, the total percentage of shares held by Finsbury Investments is 58 %, more than what the entire Ventriglias own which is 42 %. Second, independent auditors report proving that the cement factory ran as a joint venture group with Dr. Rajan Mahtani being the sole joint venture partner. Rest others had minority shares in the factory. The major claim made by the Ventriglias is that the shares held by Finsbury Investments are not paid for. However, this claim has been dismissed as Finsbury have valid agreements and exhibits that clearly indicate that Dr. Mahtani has not only paid for the shares capital but has also invested in excess of USD 8 million in the factory over the course.
Without any proper evidence or factual data, the Ventriglias have time and again resorted to false accusations like accusing Dr. Mahtani of arm-twisting and bribing government officials to bend the judgment in their direction. However, things have changed and it is expected that the court will make the right judgment this time.
