In the Portland
Cement Zambia case, various ups and downs as well as turning points
have been seen till now. However, none of these turning points were
helpful in providing transparent and quick justice for the cement
factory and the people associated with it. Even the latest final
verdict announced by the judge at the Lusaka High Court raised more
question than ever, forcing Dr. Rajan Mahtani to take immediate
action.
The Portland
Cement Zambia factory used to have surplus production under the
leadership of Dr. Rajan Mahtani. The factory was also noted for its
above-industry average salaries and wages, attracting workers from
across the nation. During its glory days, the factory has achieved
numerous achievements and awards for its profitability, working
principles as well as its contributions to the society. Therefore, it
is extremely difficult to see the same factory in ruins sue to an
event which could have been avoided with amicable solutions. The only
reason Dr. Rajan Mahtani registered the case was he did not want to
sort to any unethical or illegal practice to get back his factory.
However, he had to face the consequences of a challenging legal
institution within the nation, dragging the case to almost 10 years
without any conclusion.
Though some
positive news was announced when the judge closed the case hearing
and announced that final judgment will be based on evidences, it was
not as expected. The final judgment was against Dr. Mahtani’s
claims, shocking everyone. As such, Dr. Mahtani has now appealed to
the higher court of appeal and is awaiting reply.
